TERMS OF BUSINESS

These are the Terms of Business that will apply to the work that “We”, Skeleton Search, of Flat 1, Locksmiths, 18 Durlston Road, Swanage, Dorset, BH19 2HU do for you. These Terms of Business and your acceptance of a proposal made by us in writing form the Agreement between us. If at any time you have any questions in connection with the Agreement or our work please let us know.

The Services we will provide - We will prepare a report containing a family tree and other material the extent of which will be dependent on the outcome of the research, and deliver this to you. We will use reasonable skill and care in the research and preparation of our report.

|
Results - The extent of any discovery cannot be guaranteed and is dependent on the survival and accessibility of archives and other records. Family history research can on occasion result in discoveries that may be uncomfortable for clients or others to accept. Our role is to report objectively what the records reveal. We will indicate any assumptions made. If research reaches a rapid dead-end then we may at our sole discretion refund part of your fee or deposit.

Delivery - Research and report preparation will usually take about six weeks. We will let you know should there be any delay.

Fees - Fees will be calculated in accordance with the table of Fees and Expenses. We will agree fee ceilings with you in advance.

Expenses - All fee estimates are stated exclusive of expenses. Travel and subsistence expenses while conducting research within Greater London will not be chargeable. For work outside Greater London you agree to pay our travel, subsistence and other reasonable expenses incurred in connection with the Services. You agree to pay for all copies of certificates or other archives necessarily or reasonably made in the course of our research.

Payment - A deposit is payable before we start any research. Subsequent invoices are payable on demand. E-mail Invoices will contain a link to PayPal to enable payment by credit card. If you prefer you can also pay by cheque made payable to ‘Simon Kidner’.

| Return of Property - At the end of our work we will return to you any property of yours that we then have in our possession.

|
Confidentiality - We will not disclose to any other party any information discovered in the course of our research, unless it is necessary to do so in pursuance of that research or the preparation of the report. If some matter would reasonably be considered as confidential then we shall seek your agreement before disclosing it. For the avoidance of doubt, we have your agreement to disclose — but only where and when necessary — your mother’s maiden name.

References - We will not disclose your name or address to any prospective client wishing to obtain a reference without first obtaining your permission.

|
Liabilities and complaints - Nothing in this Agreement will affect your legal rights as a consumer. If you are not satisfied with the report we will endeavour to rectify the situation if it is reasonably possible to do so and in view of the fees paid or owed. In any event our liability, except where by law it cannot be limited, will not exceed the value of fees paid. Please address any complaints to Simon Kidner in writing.
